Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 1st Respondent to consider the petitioner’s representation dated 23.10.2021 and also direct the 1st Respondent for enhancing the amount of compensation by making a reference to the appropriate authority as per section 64 of the Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for the petitioner’s lands measuring 4262 square meters, comprised in Survey Nos.225/1 (225/1B), 225/2 (225/2B), 225/4 (225/4B), 225/5 (225/5B), 225/6 (225/6B) and 225/7 (225/7A), situate in Kattunemili Village, Ulundurpettai Taluk, Kallakurichi Distirct, acquired by the respondents by fixing Government Guideline value prevailing in that area and to pay the same to the petitioner AMENDED AS Writ of Certiorarified Mandamus calling for the records pertaining to letter Na.Ka.No.A/01/2022 dated 20.10.2022 of the 2nd respondent and to quash the same and directing the 1st respondent to enhance the amount of compensation by making a reference to the appropriate authority as per section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 for the petitioners lands measuring 4262 Square Meters, comprised in Survey Nos. 225/1 (225/1B), 225/2 ( 225/2B), 225/4 (225/4B), 225/5 (225/5B), 225/6 (225/6B) and 225/7 (225/7A), situate in kattunemili Village, Ulundurpettai Taluk, Kallakurichi Distirct, acquired by the Respondents by fixing the value prevailing in that area and to pay the same to the petitioner.

ORDER

Though this Writ Petition was originally filed for a Writ of Certiorarified Mandamus to quash the second respondent’s letter vide Na.Ka.No.A/01/2022 dated 20.10.2022, the petitioner now restricts his prayer and seeks a direction to the first respondent to consider his representation dated 23.10.2021 and refer the matter to the appropriate authorities for an enhancement of compensation. 2. In view of the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to dispose of the petitioner’s representation dated 23.10.2021, by issuing due notice and opportunity of personal hearing to the petitioner as well as aggrieved parties, if any, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

3. With the aforesaid direction, this writ petition stands disposed of. No costs.
