Prayer: This petition is filed under Article 226 of the Constitution of India, seeking writ of mandamus, to direct the respondents to appoint the petitioners as Assistant Engineer (Civil/Mechanical) by following the method of recruitment by transfer as per Special Regulations, 1982 with all consequential service seniority and monetary benefits on the representations dated 17.05.2019 and 29.06.2021 submitted by the petitioners within a period to be stipulated by this Honourable Court.

ORDER

This writ petition is filed for the following relief:

“To direct the respondents to appoint the petitioners as Assistant Engineer (Civil/Mechanical) by following the method of recruitment by transfer as per Special Regulations, 1982 with all consequential service seniority and monetary benefits on the representations dated 17.05.2019 and

29.06.2021 submitted by the petitioners.”

2. The petitioners are working as a Junior Assistant in the respondent department. The petitioners would submit that as per Special Service Regulations, 1982, the post of Assistant Engineer is recruited by a ratio of 3:1 i.e., three graduate engineers by direct recruitment or by transfer and one diploma holder by promotion. The petitioners possess necessary qualification for the appointment to the post of Assistant Engineer by transfer. In this regard, the petitioners have made a representation dated 29.06.2021. However, the same has not been considered. Therefore, seeking a mandamus to direct respondents to appoint them in the said post, the petitioners are before this Court.

3. The learned counsel for the petitioner would submit that notification dated 02.02.2024 has been issued to fill up 216 vacancies in the post of Assistant Engineer (Civil / Mechanical). He would further submit that the petitioners are fully qualified and eligible to be appointed in the said post and if the said vacancies are filled up the petitioners may not get appointment to the said post.

4. Heard the learned counsels on the either side and perused the records.

Considering the facts and circumstances of the case and the fact that the petitioners’ representation dated 29.06.2021 has not been considered, the respondents are directed to consider the same and pass orders on its own merits, within a period of 6 weeks from the date of receipt of a copy of this order. It is made clear that till the disposal of the petitioners’ representation, two seats shall be kept vacant.

6. With the above direction, this writ petition is allowed.

Consequently, the connected miscellaneous petitions are closed. No costs.
