Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Certiorari call for the entire records pertaining to the impugned order passed by the 1st respondent in G.O.(D) No.601, dated 05.06.2025 and to

quash the same as illegal, incompetent, arbitrary.

ORDER

This petition has been filed challenging the impugned order passed d by

the 1st respondent in G.O.(D) No.601, dated 05.06.2025 and to quash the same

as illegal, incompetent, arbitrary.

2.The learned counsel for the petitioner would submit that the petitioner

completed her Higher Secondary Course in the year 2025 and thereafter appeared for the NEET examination. She applied for admission to MBBS & BDS courses for the academic year 2025-2026 and secured 220 marks therein. However, a seat was wrongly allotted to her under the Management quota with a different application number, and the same was not properly communicated to her either through any mode of communication including her registered mobile or registered email ID. Hence, the petitioner was unable to participate in the

Stray Vacancy Round at the appropriate time. Solely for this reason, she was subsequently debarred from participating in further rounds of counselling and is also likely to be debarred for the academic year 2026-2027. The petitioner made a representation through email dated 23.12.2025 seeking revocation of the debarment and permission to participate in future counselling processes. However, the same was mechanically rejected by the respondent by stating that “as per clause 1-(n) of the Prospectus issued in G.O.(D) No.601 Health and Family Welfare Department dated 05.06.2025, no communication will be directly sent to the candidates. The said clause 1-(n) of the G.O is arbitrary and contrary to Clause 1-(u) of the very same Prospectus. Accordingly he prayed

for appropriate orders.

3.Per contra, the learned Special Counsel appearing for the respondents

would submit that the G.O (D) No.601 approving the Prospectus for the year 2025-2026 for admission to MBBS and BDS was issued on 05.06.2025. However, the said Government Order, which governed the admission process, has already been acted upon and the admission have been completed. It is further submitted that the petitioner has challenged the said Government Order belatedly, at a stage when the admission process has already concluded and therefore, the writ petition is not maintainable. Hence, she prays for dismissal of

the petition.

4.Heard the learned counsel on either side and perused the materials

available on record.

5.The Court has considered the rival submissions made on either side. It

is evident that the impugned G.O.(D) No.601 dated 05.06.2025, which governs the Prospectus for admission to MBBS and BDS courses for the academic year 2025-2026, has already been acted upon and the entire admission proc
