O R D E R
The writ petition was filed to quash the impugned order dated 04.12.2009 and consequently to direct the respondent to appoint the petitioner as a Secondary Grade Teacher. After hearing the rival submissions, this Court allowed the writ petition, quashed the impugned order and further held that an interim order dated 02.02.2010 had been passed directing the respondent to keep one post of Secondary Grade Teacher vacant pending disposal of the writ petition and the said order till continues. Therefore, the Court directed the respondent to appoint the petitioner as a Second Grade Teacher pursuant to Memorandum in R.C.No.5015/B4/2008 dated 23.11.2009 and accordingly directed the respondent to proceed further to appoint the petitioner as Second Grade Teacher within four weeks and further once she is appointed pursuant to the said selection order, the appointing authority concerned shall date back her appointment to the original date of appointment, where any one of her batch mates was appointed during the selection in the year 2009 to 2011 and from that date, her service has to be counted. Since the petitioner is out of service for all these years, she would not be entitled to claim any financial benefit all these years. Based on the above order, alleging disobedience of the order of this Court, the present contempt petition has been filed.
2. The contention of the petitioner is that she ought to have been promoted as Headmistress and not the secondary grade teacher. The respondent submitted that the order of this Court has been duly complied with. The petitioner was appointed as a Secondary Grade Teacher, her appointment was given retrospective effect, and her service has been counted from the date of such appointment. 3. Now the petitioner is seeking the post of Headmistress, which was not the direction issued by this Court. The petitioner is misinterpreting the order relating to the retrospective effect of her appointment by comparing herself with similarly placed persons, wherein one of her batch mates has been subsequently promoted. However, there was no direction by this Court to promote the petitioner.
4. In view of the above, this Court is not inclined to accept the petitioner's contention. There is no contempt as alleged, as the order passed by this Court has been complied with.
5. Accordingly, this Contempt Petition is closed.
