ORDER

The Criminal Original Petition has been filed to withdraw and transfer the case in C.C. No.152 of 2025 (arising out of Crime No.01 of 2023 on the file District Crime Branch, Ariyalur) now pending on the file of the District Munsif- cum-Judicial Magistrate, Sendurai, Ariyalur District to the file of the Chief Metropolitan Magistrate, Egmore, Chennai where C.C. No.2778 of 2023 (arising out of Crime No.245 of 2021 on the file of the Central Crime Branch, Chennai).

2.The contention of the petitioner is that his daughter's, sister-in-law was married to one Ramesh. When the petitioner had visited his daughter’s residence, the said Ramesh informed him that he was acquainted with several IAS officers and that one among them was posted in Chennai, and that he could secure employment in various Government Departments. Believing the said representations, monies were collected from various persons for the purpose of securing employment and were deposited into the bank account of the said Ramesh. It is further submitted that certain amounts were also handed over to him in cash. However, the petitioner is now facing prosecution in connection with the same. The petitioner further submits that the said Ramesh has also been arrayed as an accused in C.C. No. 152 of 2025 and is facing trial in C.C. No. 2778 of 2022 on the file of the Chief Metropolitan Magistrate, Egmore, Chennai.

3. The respondent has filed a status report, from which paragraphs 2 to 10

10 are extracted hereunder:

"2. I respectfully submit that the case of the prosecution is that, the defacto complainant namely Tr.Jayaraman, S/o.Thangavel lodged a complaint before the respondent police in which stating that, he is working as an electrician and plumber. In the month of December 2021, visited relative Anbazhagan, son of Kaliyaperumal. At that time, Selvarasu/A-1, son of Ramasamy, a resident of Kodukkur Village, was also present there. During our conversation, Selvarasu/A-1 informed that he could arrange government employment through his contacts and asked whether, the complainant knew any candidates seeking such employment. When he came to know that the complainant son had completed B.E. Civil Engineering, he assured that he could secure a Municipal Engineer post for his son if he paid a sum of Rs.3,50,000/-.

3. I respectfully submit that, believing his representation, complainant arranged the said amount and on 21.12.2021 handed over Rs.3,50,000/- in cash to Selvarasu/A-1 at the residence of Kolanjinathan at Marudur. At that time, several other persons also paid various amounts to Selvarasu/A-1 for securing government employment for their relatives, namely: Anbazhagan - Rs.1,50,000/- for his son Silambarasan; Anbazhagan of Paranur Rs.2,00,000/- for his son Anand; Rathna, wife of Ramesh Rs.3,00,000/--Manimegalai,
