A transfer petition can be disposed of on the basis of settlement reached during mediation without further adjudication.

Headnote:The petitioner sought transfer of O.S.No.28 of 2024 under Section 24 of the Code of Civil Procedure from the District Munsif Court, Palladam to the District Munsif Court, Nanguneri. The petitioner's learned counsel and the respondent's counsel both submitted before the Court that the parties had settled their dispute during mediation. The Court consequently disposed of the transfer petition after noting the mediation report confirming settlement.

O R D E R

The Civil Miscellaneous Petition has been filed seeking orders to withdraw the suit in O.S.No.28 of 2024 from the file of the District Munsif Court, Palladam and and transfer the same to the District Munsif Court, Nanguneri, Tirunelveli District.

2. When the matter is taken up for hearing today, the learned counsel on either side would submit that the parties have entered into a settlement during mediation.

3. The Mediation Centre attached to this Court has also submitted a report stating that the mediation has been completed and that the parties have entered into an agreement.

4. In view of the above, this Transfer Civil Miscellaneous Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
