Direction issued to consider representation on delayed interest payment over land acquisition compensation.

PRAYER – This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, directing the 1st respondent to pay interest on the compensation amount of Rs.15,88,525/- paid towards 1/3rd development charges as per the award dated 30.08.2025 in Na.Ka.A1/2674/2019 calculated from the date of the original award in Na.Ka.A1/2674/2019 dated 20.06.2024 at the rate of 9 % per annum for the first year i.e., 19.06.2025 and thereafter at the rate of 15 % per annum till 25.10.2025 being the date on which the compensation amount was deposited into petitioners account upon consideration of his representation dated 17.12.2025 within the time frame.

O R D E R

This Writ Petition has been filed to direct the 1^st respondent to pay the interest on the compensation amount of Rs.15,88,525/- paid towards 1/3rd development charges as per the award dated 30.08.2025 calculated from the date of the original award dated 20.06.2024 at the rate of 9% per annum for the first year, i.e. 19.06.2025 and thereafter at the rate of 15% per annum till 25.10.2025, being the date on which the compensation amount was deposited into petitioner’s account based on the petitioner’s representation dated

17.12.2025, within a time frame to be fixed by this Court.

2.The grievance of the petitioner in this Writ Petition is that there was a delay on the part of the respondents to pay the entire compensation amount to the petitioner in respect of the lands acquired from the petitioner. Only under those circumstances, the petitioner had given a representation on 17.12.2025 to the respondents.

3.Mr.Vadivelu Deenadayalan, learned Additional Government Pleader, accepts notice on behalf of the respondents. No prejudice would be caused to the respondents if the petitioner’s representation as stated supra is considered on merits and in accordance with law, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner’s representation.

4.For the foregoing reasons, this Writ Petition is disposed of by directing the 1^st respondent to pass final orders on merits and in accordance with law on the petitioner’s representation dated 17.12.2025, seeking for payment of interest on the compensation amount of Rs.15,88,525/- paid towards 1/3rd development charges as per the award dated 30.08.2025 calculated from the date of the original award dated 20.06.2024 at the rate of 9% per annum for the first year, i.e. 19.06.2025 and thereafter at the rate of 15% per annum till 25.10.2025, being the date on which the compensation amount was deposited into petitioner’s account, within a period of twelve weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs.
