Once a final report is filed in a criminal case, a petition to quash the FIR becomes infructuous.

Headnote:The petitioners filed a Criminal Original Petition seeking to quash an FIR in Crime No.258 of 2025. The first respondent submitted that a final report had been filed in C.C.No.55 of 2026. The Court found the petition infructuous due to filing of the final report. Issues before the Court were the maintainability of the quashing petition and the effect of filing a final report on such petition. The ratio decidendi is that once a final report is filed in a criminal case, a petition seeking to quash the FIR becomes infructuous and is liable to be dismissed. The petition was dismissed as infructuous and the connected miscellaneous petition was closed.
