2026 Supreme(Online)(Mad) 41407

IN THE HIGH COURT OF JUDICATURE AT MADRAS
N. Mala, J
Silambarasan – Appellant
Versus
Hasina Begum – Respondent
CMP No. 11420 of 2026 | CRP No. 2759 of 2026

Advocates:
For the Appellants/Petitioners: M/S. Parthiban Patmanabane J.Zeakumar
For the Respondents: Mr.K.V.Babu

Execution proceedings already concluded render further judicial review of the underlying order infructuous and subject to dismissal.

Headnote:The petition concerns a civil revision petition filed under Article 227 of the Constitution of India seeking to set aside an order passed in execution proceedings related to a house rent control original petition. The court reviewed the daily status report showing that the delivery of the property had been effected and the execution petition closed prior to the hearing. The court determined that the matter had become infructuous given the closure of proceedings and the execution of the delivery warrant. The primary issue was whether the civil revision petition could proceed after the underlying execution proceedings had concluded. The court reasoned that since the execution had already been completed and recorded, no further adjudication was required, leading to the petition being rendered infructuous. The Civil Revision Petition and connected miscellaneous petition were dismissed, finding no surviving issue for consideration.

Order

Mr.K.V.Babu, learned counsel accepting notice on behalf of the respondent, submitted that he undertakes to file vakalat before the Registry.

2.The learned counsel for the respondent also produced the Daily Status of the proceedings in EP.No.1/2022 and submitted that the delivery was effected, recorded and the EP was closed as early as on 06.04.2026 and therefore, nothing survives for adjudication in the Civil Revision Petition. 3.From a reading of the Daily Status of the proceedings in EP.No.1/2022, it appears that the delivery warrant was executed, the petition mentioned property was handed over to the petitioner and the delivery was effected. Even the stay petition filed by the third party, was returned and the EP was closed on

06.04.2026, recording delivery.

4.In view of the fact that the Execution Proceedings was closed, recording delivery, as early as on 06.04.2026, this Court finds that nothing survives for adjudication in this petition.

5.Hence, the Civil Revision Petition is dismissed. No costs.
