PRAYER Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 3rd respondent to transfer the land of 1.41 Acres to SIDCO based on the proceedings in Ni. Mu. 8395 / 81-T1 dated 27.02.1984, and directing the 5th respondent to transfer the land area of the shed No. 3 allotted to the eptitioner for Industrial Establishments in Survey No. 401 and 402 situated at Chettikarai Panchayat, Dharmapuri District within a reasonable time, on merts For Petitioner(s): No appearance For Respondent(s): Mr.T.K.Saravanan, AGP for R1, 3, 4, 6 & 7 R2 – No appearance Mr.Sitharai Sarangan, for R5
ORDER
This writ petition has been filed to direct the 3rd respondent to transfer the land of 1.41 Acres to SIDCO based on the proceedings in Ni. Mu. 8395 / 81-T1 dated 27.02.1984, and directing the 5th respondent to transfer the land area of the shed No. 3 allotted to the petitioner for Industrial Establishments in Survey No. 401 and 402 situated at Chettikarai Panchayat, Dharmapuri District.
2. Today, there is no representation on behalf of the petitioner.
3. On the other hand, the learned counsel for the 5th respondent would submit that at present, the petitioner is in possession of the Shed No.3 and once the entire land is re-classified, certainly, the subject land will be transferred to the petitioner. Hence, he requests this Court to pass appropriate order.
4. Heard the learned counsel for the 5th respondent and perused the entire materials available on record.
5. The submission made by the learned counsel for the 5th respondent is hereby recorded. Once after the completion of re-classification of land, the 3rd respondent shall transfer the subject Shed No.3 to 5th respondent. Subsequently, 5th respondent shall transfer the said Shed No.3 to the petitioner. Till then, the peaceful possession of the petitioner shall not be disturbed.
6. With the above directions, this writ petition is disposed of. No cost.
