Writ of Certiorarified Mandamus granted to quash police order rejecting permission to hold cultural program, if held with peaceful observance of law and order.

Headnote:The petitioner sought to quash an order issued by the Inspector of Police rejecting a representation to conduct an "Adal Padal" programme along with a customary temple festival in Maniyampatti Village, Virudhunagar District. The court noted the statutory basis under Article 226 of the Constitution of India and the circular issued by the Director General of Police dated 09.04.2019 regarding the conduct of such programmes. After considering the petitioner’s undertaking and the requirement for peaceful observance of law and order, the court held that the impugned order was unsustainable. The court concluded that the petitioner may conduct the "Adal Padal" programme on 17.05.2026, provided he complies with his undertaking affidavit and the DGP circular.

O R D E R

The petitioner is the committee member of Punitha Susaiyappar Alayam, Maniyampatti Village, Sattur Taluk, Virudhunagar District. The petitioner, on behalf of the Maniyampatti Village people, has submitted a representation before the Inspector of Police, Appaiyanayakanpatti Police Station, Virudhunagar District, for grant of permission to conduct temple festival along with ''Adal Padal programme'' on 17.05.2026, however, the request of this petitioner for conducting ''Adal Padal programme'' was rejected by the second respondent, by the order impugned in this writ petition. Challenging the same, the present writ petition is filed.

2.The learned counsel appearing for the petitioner submits that last year also, the villagers have conducted the temple festival along with cultural programme and no untoward incident was reported. He further submits that the festival is being conducted by the entire villagers and therefore, there is no possibility of any law and order problem. The petitioner also assures that the festival will be conducted in a peaceful manner, without any law and order problem. Therefore, he requests to set aside the impugned order and to issue a direction to the respondents to grant permission to conduct the festival along with cultural programme on 17.05.2026.

3.Mr.S.Ravi, learned Additional Public Prosecutor appearing for the respondents submits that apprehending law and order problem, the representation of this petitioner for conducting ''Adal Padal Programme' was rejected, however, permission was granted to conduct the temple festival in a peaceful manner.

4.Considering the submissions made by the learned Counsel for the petitioner and also considering the undertaking given by the petitioner, this Court is inclined to set aside the impugned order.

5.Accordingly, the order passed by the second respondent in Na.Ka.No.07/Ka.Aa.A.Na.Pa/2026 dated 11.05.2026 is hereby set aside and this writ petition is allowed with the following directions:-

i. The petitioner shall file an affidavit before the respondent Police with the following undertaking:

ii. On filing of such undertaking affidavit, the second respondent Police shall grant permission for conducting the Adal Padal programme on 17.05.2026, as per the circular of the Director General of Police, Tamil Nadu/Head of State Police Force, Chennai-4, in Rc.No.007301/General I(I)/2019, dated

09.04.2019.

There shall be no order as to costs. Consequently, connected Miscellaneous petition is closed.
