R. Vijayakumar, J
Dhineshwaran – Appellant
Versus
Superintendent of Police – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: R. Sakthivel
For the Respondents: Abdul Kalam Azad

The High Court may issue a Writ of Mandamus granting conditional permission for religious cultural events, provided they adhere to time restrictions and social decency standards subject to police monitoring.

Headnote:The petitioner filed a writ petition under Article 226 of the Constitution of India seeking a Mandamus for permission to conduct a cultural program at a temple. The Court considered the petitioner's request for police protection for the scheduled event and determined that permission should be granted subject to regulated conditions. The main issue raised was the necessity of judicial intervention to secure official permission for a cultural event. The Court reasoned that while cultural programs are permissible, they must be conducted within regulated time limits and without obscenity, authorizing police intervention to ensure compliance with these standards. The writ petition is disposed of with directions to the police authorities to grant permission for the program under specified constraints.
