IN THE HIGH COURT OF JUDICATURE AT MADRAS
P. Dhanabal, J
Gomathi – Appellant
Versus
State – Respondent
Criminal Original Petition | Crime No.686/2024

Advocates:
For the Appellants/Petitioners: D. Dharani Dharan
For the Respondents: A. Damodaran

The High Court exercises its inherent power to issue directions to police authorities to expedite the completion of investigations and the filing of final reports within a fixed timeframe in criminal proceedings.

Headnote:The petitioner filed a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking a direction to the respondent police to expedite the investigation and file a final report regarding a 2024 criminal case. The court noted the submission of the Additional Public Prosecutor regarding the status of the investigation and the request for additional time. Consequently, the court granted two months for the completion of the investigation and the filing of the final report. The main issue was the delay in the investigative process and the need for a judicial directive to ensure its completion. The court observed that given the registration date of the FIR, a fixed timeframe for procedural compliance was necessary to uphold the mandate of investigative efficiency. The Criminal Original Petition was disposed of with a direction to complete the investigation within two months.
