2026 Supreme(Online)(Mad) 42289

IN THE HIGH COURT OF JUDICATURE AT MADRAS
D. Bharatha Chakravarthy, J
Saraswathiammal – Appellant
Versus
Inspector General of Registration – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: J.Roshini
For the Respondents: A.Baskaran

Administrative authorities are mandated to consider and rectify factual errors in registered documents upon a formal representation within a reasonable timeframe.

Headnote:The petitioner sought a writ of mandamus to rectify a clerical error in the encumbrance certificate regarding the survey number mentioned in a sale certificate registered under the Registration Act. The court noted the petitioner’s representation regarding the discrepancy and the respondents' submission to rectify such errors upon verification. The court directed the concerned authority to consider the representation in accordance with the law within a specified timeframe. The main issue was whether the statutory authority is required to correct factual errors in registered documents upon formal request. The court held that the representation must be processed and resolved through the proper administrative procedure to ensure the records reflect correct property details as per the registered sale certificate. The writ petition is disposed of with directions to the respondent to pass final orders on the representation within four weeks.

ORDER

The grievance of the petitioner is that when the petitioner had presented the sale certificate dated 03.01.1992 and which is also duly filed and registered as Document No.1 of 1992, the same is not reflected with reference to the concerned survey numbers, namely, S.No.61/6 and the same is wrongly reflected in S.No.6/6. The petitioner had only made a representation dated 06.04.2026.

2. When the matter came up for hearing, the learned Additional Government Pleader would submit that the said representation will be considered by the third respondent in the manner known to law and error, if any, will be corrected and the sale certificate will be duly reflected in the correct survey number.

3. In view thereof, this Writ Petition is disposed of on the following terms:

The representation of the petitioner, dated 06.04.2026, shall be considered by the third respondent and final orders in accordance with law shall be passed as expeditiously as possible, in any event not later than four weeks from the date of receipt of a web copy of the order.

No costs.
