IN THE HIGH COURT OF JUDICATURE AT MADRAS
C. Saravanan, J
Samruddhi Transcorp Private Limited – Appellant
Versus
Assistant Commissioner (ST), Alwarpet Assessment Circle – Respondent
W.M.P.Nos.17382 and 17384 of 2026

Advocates:
For the Appellants/Petitioners: V.Janarthanan
For the Respondents: T.N.C.Kaushik

A court may exercise its writ jurisdiction to remit a tax matter for de novo adjudication where the petitioner consents to a pre-deposit of a portion of the disputed tax, notwithstanding the expiry of the statutory appeal limitation period, provided strict compliance conditions are met.

Headnote:The petitioner challenged an assessment order dated 29.07.2025 issued under relevant GST enactments following a failure to participate in the Show Cause Notice proceedings. The court noted that the limitation period for filing a statutory appeal under Section 107 had expired by the time the writ petition was initiated. Considering the petitioner's willingness to deposit 25% of the disputed tax, the court framed the issue around whether a de novo adjudication could be permitted conditional upon pre-deposit. The Court highlighted that procedural fairness and compliance with statutory filing requirements are critical, but granted relief by remitting the matter back to the assessing authority subject to strict compliance. Ultimately, the writ petition was disposed of with the direction to remit the matter for fresh adjudication upon the petitioner's compliance with payment and filing stipulations, resulting in the vacation of bank attachments upon fulfillment of these conditions.
