IN THE HIGH COURT OF JUDICATURE AT MADRAS
P.T. Asha, J
V. Arunkumar – Appellant
Versus
State of Tamil Nadu – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: N. Umapathi
For the Respondents: R.U. Dinesh Rajkumar

When a public servant seeks transfer through representation, the court may direct the concerned administrative authority to consider and dispose of such a representation on its merits within a fixed time frame.

Headnote:The Writ Petition was filed under Article 226 of the Constitution of India seeking a writ of mandamus to compel official respondents to notify specific hospital positions as vacant for transfer counselling and to process the petitioner's representation for transfer. The court examined the facts regarding a long-serving medical officer seeking a transfer for personal family reasons. The central issue involved the petitioner's request for transfer based on personal hardship and the failure of authorities to act upon repeated representations. The court noted the absence of serious objections from the respondents and determined that the matter should be resolved by directing the authorities to consider the merits of the representation within a specific timeframe. The Writ Petition was disposed of with a direction for the respondents to consider and pass orders on the petitioner’s representation dated 10.03.2026, in accordance with law, within six weeks.
