Prayer: Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondent authorities 1 and 2 to consider the petitioner’s representation dated 14.06.2024 and direct the respondent authorities 1 and 2 to conduct appropriate enquiry on the petitioners representation.

ORDER

The present Writ Petition has been filed seeking a direction to the 1^st and

2^nd respondent to consider the petitioner’s representation dated 14.06.2024 and to conduct appropriate enquiry on the same.

2. It is the case of the petitioner that he is in possession of the agricultural lands comprised in Survey Nos.253/2B, 262/1X, 263/3 and 262/1E. Based on the said possession, a joint patta was grant in favour of the petitioner as well as the 3^rd respondent who is the adjacent land owner. Whileso, the 3^rd respondent had filed an application before the 1^st and 2^nd respondent seeking permission for laying pipelines through the petitioner’s property for commercial purpose. Based on which, the respondents are trying to lay the pipeline in the petitioner’s property. Aggrieved by which, the petitioner filed a civil suit before the Sub Court, Attur in O.S.No.94 of 2024 seeking permanent injunction against the 3^rd and 4^th respondent from interfering with the petitioner’s peaceful possession. Pending the suit, the petitioner also submitted a representation dated 14.06.2024 to the official respondents requesting for non-laying of the pipeline in his property till the disposal of the civil suit. However, till date, no orders have been passed on the same. Hence, the present Writ Petition.

3. Though very many grounds have been raised, learned counsel appearing for the petitioner submitted that, it would suffice, if this Court passes appropriate orders to restrain the respondents from laying pipelines in the petitioner’s property till the disposal of the civil suit.

4. On the above contention, this Court heard the learned counsel appearing for the respondents who have no objection to the said order being passed.

5. Considering the fact that civil suit relating to permanent injunction is pending adjudication, this Court, without expressing any opinion on the merits of the case, directs the respondents not to proceed with or consider any applications for laying pipeline in the petitioner’s property till the disposal of the suit. However, liberty to granted to the petitioner as well as the respondents 3 & 4 to workout their remedies in the manner known to law after the disposal of the civil suit. Further, the party who succeeds in the suit is at liberty to make fresh application before the respondents authorities.

6. The Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
