JUDGMENT
(Judgment of the Court was delivered by R.SURESH KUMAR, J.)
This writ appeal has been directed against the order passed by the
Writ Court dated 01.03.2023 made in W.P.No.11539 of 2015.
2. The issue was that, the Teacher concerned, who is otherwise
qualified to be a B.Ed. Graduate, had been appointed in the sanctioned vacancy of Secondary Grade Teacher and not only the said Teacher, several other Teachers with that qualification since have been appointed as Secondary Grade Teachers, the issue has ultimately come up before this Court in a batch of cases, where, without the proper qualification of Diploma in Teacher Education Course, whether the Teacher could be appointed as a Secondary Grade Teacher, as Child Psychology is one of the important subjects which has not been or never been taught to those Teachers, to deal with the students of the School upto second or third
Standard.
3. That issue was ultimately decided by a Division Bench of this
Court, where, the Government was directed to send all those Teachers, who were having the qualification of B.Ed. Degree to hold the post of B.T. Assistant, instead, since has been appointed as Secondary Grade Teachers, for Child Psychology Training for a particular period. Pursuant to the same, the Government passed orders in 2003 itself, allowing all those Teachers to take the Child Psychology Training in order to

regularise or ratify their appointments to the post of Secondary Grade
Teacher from the date of their initial appointment.
4. Pursuant to the decision made by this Court and the orders
passed in this regard by the Government, the Teachers, though not in one stroke, but in a phased manner, have been sent for Child Psychology Training. Some of them immediately have been sent for Training and
some of them belatedly have been sent after several years.
5. Ultimately, the Teachers who were sent for Child Psychology
Training after some years for want of availability in the Training Centres, whether those Teachers who completed Child Psychology Training after some years would be entitled to get regularisation as Secondary Grade Teachers from the date of their initial appointment or not was again the question to be decided by this Court in a number of cases. The present writ petition is also one such case, where, the very same issue had come, as the Teacher has not been given regularisation from the date of her initial appointment by citing the reason that the Teacher has gone for
Child Psychology Training belatedly.
6. The learned Single Judge who passed the order impugned dated
01.03.2023 had allowed the writ petition by following some earlier orders
passed in this regard.

7. Aggrieved over the same, this intra-Court appeal has been filed
