PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the 1st respondent to disburse Gratuity amount of Rs.2,31,795/- along with interest rate of 10 percentage as per the 2nd Respondent order in P.G.No. 43/2024 as well as the Gratuity Act and considering the petitioner representation dated 18.11.2025.

ORDER
The present Writ Petition has been filed seeking issuance of a Writ of
Mandamus directing the 1st respondent to consider the petitioner’s
representation dated 18.11.2025.
2. The case of the petitioner is that he was appointed as a fresh entrant
‘Conductor’ in the respondent Corporation on 20.08.2003 and following the regularization of his services, retired on attaining the age of superannuation on 29.02.2020. Upon the respondent’s failure to settle the petitioner’s terminal benefits, the petitioner approached the Controlling Authority under the Payment of Gratuity Act, 1972, (P.G.No.43 of 2023). The Controlling Authority directed the respondent Management to pay the gratuity amount along with 10% interest from the date of retirement. Challenging the same, the Management has preferred an appeal before the Appellate Authority in P.G.Appeal Case
No.26/2024, which was subsequently dismissed on 16.04.2025.

3. It is the further case of the petitioner that notwithstanding the dismissal
of the appeal and the affirmation of the original order, the first respondent has wilfully failed to disburse the amount. Therefore, the petitioner made a representation dated 18.11.2025 before the 1st respondent seeking disbursement of the gratuity amount of Rs.2,31,795/- along with interest at the rate of 10%; however, the same has not been settled till date. Challenging the same, the
present Writ Petition has been filed.
4. Heard the learned counsel for the petitioner and the learned Standing
Counsel appearing for the first respondent Corporation.
5. Considering the fact that the Appellate Authority has already dismissed
the appeal filed by the Management and confirmed the order of the Controlling Authority, this Court finds no legal impediment in granting the relief sought. Accordingly, the 1st respondent is directed to pay the gratuity amount of Rs.2,31,795/- along with interest at the rate of 10% per annum calculated from the date of retirement till the date of actual disbursement, within a period of six
(6) weeks from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition stands disposed of. There
shall be no order as to costs.
