ORDER

This writ petition is filed to direct the 1st and 2nd respondents to cancel the sale deed No.5116 and 5117/2012 on 30.3.2012 on the file of the 2nd respondent based on the recommendation made by the 3rd respondent dated

22.04.2022 vide Letter No.Ta.Thi.Nee.Maa.34/2004- 2005.

2. When the matter was taken up for hearing, learned Government Advocate appearing for the respondents 1 to 3 would submit that the Division Bench of this Court has struck down the provisions of Section 77A and 68(2) of the Registration Act. Hence, they are not in a position to issue direction regarding cancellation of sale deed.

3. Recording the submission made by the learned Government Advocate appearing for the respondents 1 to 3, this writ petition is dismissed with liberty to file a civil suit before the Civil Court in the manner known to law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
