ORDER
Seeking to direct the respondent to conduct further investigation in
C.C.No.1460 of 2004 on the file of the learned Judicial Magistrate, Pattukkottai, Thanjavur District, based on the petitioner's representation dated
23.04.2025 and file a supplementary final report, this writ petition is filed. 2. The learned counsel for the petitioner submitted that the marriage
between the petitioner and V.V.Balasubramanian was held on 24.03.2002. However, indifferences crept in their matrimonial life because of the dowry harassment suffered by her in her matrimonial home. In the meanwhile, the petitioner's husband had also married another woman during the subsistence of the first marriage with the petitioner and hence, the petitioner had lodged a complaint, pursuant to which First Information Report in Crime No.5 of 2003 was registered on 10.07.2003 for the offences under Sections 498A and 494 of IPC and Sections 4 and 6 of Dowry Prohibition Act. The same culminated in laying a final report in C.C.No.1460 of 2004 on the file of the learned Judicial Magistrate, Patukottai for the aforesaid offences, where the said V.V.Balasubramanian was arrayed as Accused No.1 along with 3 other accused. Subsequently, V.V.Balasubramaniam filed Crl.M.P.No.7477 of 2018 in C.C.No. 1460 of 2004 before the learned Judicial Magistrate, Pattukottai seeking

discharge from the charge under Section 494 IPC. The same was dismissed by the learned trial Court, against which he had filed a Criminal Revision Petition No.19 of 2019 before the III Additional District Judge, Thanjavur @ Pattukottai, which was also dismissed. Against which, he preferred a petition under Section 482 Cr.P.C before this Court in Crl.O.P(MD)No.12982 of 2023 and the same was allowed. The petitioner herein challenged the said order passed by this Court by preferring S.L.P.(Criminal)No.7178 of 2024 before the Hon'ble Supreme Court and the same was allowed on 26.03.2025. In the interregnum, pursuant to the order passed by this Court in Crl.O.P(MD)No. 12982 of 2023, the learned trial Court had struck off the charge framed under Section 494 IPC and had proceeded with the trial and P.W.1 has already been examined in chief. However, since the Special Leave Petition preferred by the petitioner has been allowed, it is necessary for the trial Court to restore the struck off charge under Section 494 IPC as against the said V.V.Balasubramanian. In this regard, the learned counsel for the petitioner points out that it is necessary that certain documents should also be marked
through the petitioner.
3. The learned Government Advocate (Crl.side) submitted that at the time
of investigation, these documents were not produced by the petitioner. It is
