..Respondent PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to consider the petitioner’s representation dated 30.04.2025 requesting for promotion as Lower Division Clerk in the 2nd respondent school and pass appropriate orders thereon within a time limit to be fixed by this Court.

ORDER

The writ petition has been filed seeking a mandamus to the 1^st respondent to consider the petitioner's representation dated 30.04.2025 with regard to her promotion as Lower Division Clerk in the 2^nd respondent-School.

2. It is the case of the petitioner that he was employed in the 2^nd respondent- Government Aided School, as Sanitary Helper on 01.10.1988 and now was redesignated as Multi-Tasking Staff (Security). He possesses degree in M.A., DCA and also passed Typewriting Junior Grade, which is a prescribed qualification for Lower Division Clerk category (LDC). He would submit that one Mr.John Kennedy, Upper Division Clerk had retired from service on 30.04.2025, as a result, a consequential vacancy has arose in the LDC post. The petitioner having possessed the required qualification for LDC post, he submitted his representations on 30.04.2025 and 09.07.2025 to the 1^st respondent, but the same was not considered to date. Hence, the petitioner is before this Court.

3. The learned counsel appearing for the petitioner would submit that the petitioner was without promotion since 01.10.1988. He also submits that the Recruitment Rules for the Lower Division Clerk provides for filling up the posts qua 60% by direct recruitment and 40% by promotion from the post of Multi- Tasking Staff (General), Multi Tasking Staff (Security) and Multi-Tasking Staff (House Keeping) respectively. Hence, the petitioner's candidature can be considered for the post of Lower Division Clerk in the 2^nd respondent School.

4. Since the limited scope of prayer is to consider the petitioner's representation, this Court, without going into the merits of case, directs the first respondent to consider the petitioner's representations and pass orders in accordance with law, within a period of one month from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. No costs.
