173 of Motor Vehicles Act, 1988, against the fair and decreetal award passed by the learned Motor Accident Claims Tribunal( Special Sub-Court No.I, Motor Accident Claims Petition, Small Causes Court, Chennai dated 28.04.2025 in M.C.O.P.No.2115 of 2022.

1. Meerebah 2.G.Lakshmi ... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.M.Jayaraj, learned counsel for the appellant and M/s.N.Radhika, learned counsel for the 1st respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The appellant has preferred this Civil Miscellaneous Appeal challenging the Award dated 28.04.2025 in M.C.O.P.No. 2115 of 2022 passed by the learned Motor Accident Claims Tribunal, Special Sub-Court No.I, Motor Accident Claims Petition, Small Causes Court, Chennai
2. The Tribunal has passed an award of Rs.6,14,700/- with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.
3. The parties are present along with their respective counsels. The appellant/insurance company has preferred the present Civil Miscellaneous Appeal challenging the award dated
28.04.2025.
4. After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.7,70,000/- (Rupees seven lakh seventy Thousand Only) over and above the amount already deposited by the appellant/ insurance company, as full quit compensation.
5.The appellant/insurance company already deposited a sum of Rs.25,000/-(rupees twenty five thousand only).
6. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree that appellant/Insurance Company shall deposit the balance amount of Rs,7,45,000/- (rupees seven lakh forty five thousand only) in full quit within a period of four weeks from the date of receipt of a copy of this award. On such deposit, the 1st respondent is permitted to withdraw the entire award amount immediately without filing any formal petition, before the competent Court.
The pay and recovery order of the tribunal is confirmed.
7. The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
