ORDER

The present Writ Petition has been filed seeking a direction to the respondents to conduct a survey and fix the four boundaries by erecting survey stones in respect of the petitioner’s land comprised in Survey No.148/2F, measuring an extent of 95 cents, covered under Patta No.1844, situated at Thuvarakurichi Village, Marungapuri Taluk, Trichy District, based on the petitioner’s application dated 02.01.2024.

2. The petitioner purchased the property from the 3rd respondent under Document No.3465/2023 dated 06.12.2023. Thereafter, the petitioner mutated the revenue records and has been in possession and enjoyment of the property. However, a dispute arose in respect of the property, as the legal heirs of the 3rd respondent disputed the said sale deed. Hence, the petitioner filed a suit in O.S.No.94 of 2024 on the file of the Additional District Munsif Court, Manapparai, and obtained an ex parte decree. In such circumstances, the petitioner seeks a direction to the respondents to conduct a survey of the property.

3. Therefore, the 1^st Respondent is directed to conduct a survey, measure the property with the assistance of the 2^nd Respondent. The official respondents shall adhere to the following Standard Operating Procedures:

(i) The official respondents shall issue notice to the Petitioner as well as the 3^rd respondent immediately upon reaching the site where the survey is to be conducted in accordance with law.

(ii) After the survey, the Petitioner shall affix his signature again, indicating that the survey was conducted to his satisfaction.

(iii) If the parties are not satisfied, the Petitioner shall still affix his signature, indicating his dissatisfaction or protest, along with the reasons for such dissatisfaction or protest. (iv) The aforesaid procedure shall be strictly followed by all parties. The entire exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, the writ petition stands disposed of. No costs.
