Durairaj – Appellant

Government of India – Respondent
W.P. No. 19983 of 2026

Advocates:
For the Appellants/Petitioners: C. Prabakaran
For the Respondents: M. Sathyan, B. Vijay, M. Murali

In a writ petition challenging potential land acquisition, where the statutory notification has not yet been issued, the petition is disposed of with the directive that the authorities must consider the petitioner's objections during the formal acquisition process.

Headnote:The present case involves a challenge under Article 226 of the Constitution of India regarding the apprehension of land acquisition for the Metro Rail Project. The petitioner sought a writ of certiorarified mandamus to quash an impugned communication regarding land acquisition in Pallavaram Taluk, Chengalpattu District. The core issue before the court was whether the acquisition process for the metro rail project had reached a stage necessitating formal intervention by the court. The Counsel for the respondent submitted that the mandatory notification under the land acquisition statute had not yet been issued, and existing statutory provisions would allow for the consideration of the petitioner's objections once the formal process commenced. The writ petition was disposed of with the recording of the respondent's submission that the petitioner's objections would be duly addressed during the acquisition proceedings.
