W.P. No. 19984 of 2026|W.M.P. Nos. 21342 & 21345 of 2026

Advocates:
For the Appellants/Petitioners: C. Prabakaran
For the Respondents: M. Sathyan, B. Vijay, M. Murali

Land acquisition proceedings under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 require the consideration of objections following the issuance of the formal notification under Section 3(2) of the Act.

Headnote:The petitioner challenged an acquisition process for a Metro Rail project, expressing concern that their land objections were not being considered. The Court noted the respondents' submission that the statutory acquisition process under the relevant state legislation had not yet commenced. Issues raised involved whether the current land acquisition proceedings satisfied procedural requirements for hearing objections. The Court determined that since the notification under the relevant Act had not been issued, the apprehension was premature, and the respondents were obligated to consider objections once the formal statutory process commenced. The writ petition was disposed of by recording the respondents' submission that the petitioner's objections would be duly considered upon the issuance of the statutory notification under the Act.
