IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.R. Swaminathan, J
N.S. Jalal – Appellant
Versus
Government of India – Respondent
W.P. No. 19987 of 2026|W.M.P. Nos. 21348 & 21349 of 2026

Advocates:
For the Appellants/Petitioners: C. Prabakaran
For the Respondents: M. Sathyan, B. Vijay, M. Murali

The court disposed of a writ petition challenging potential land acquisition as premature, recording the respondent's undertaking to consider the petitioner's objections once the formal statutory notification under the Industrial Purposes Act is issued.

Headnote:The petitioner challenged an impugned communication regarding the potential acquisition of land for the Metro Rail project under Article 226 of the Constitution of India. The petitioner raised concerns that the land acquisition might proceed without due consideration of his objections. The court noted the submission by the respondent that the statutory notification for land acquisition had not yet been issued. The central issue was whether the apprehension of the petitioner regarding procedural fairness in land acquisition was premature. The court determined that as the notification under the relevant state law was not yet issued, the respondents were bound to consider objections once the formal process commenced. This ensures that administrative actions adhere to statutory requirements. The writ petition was disposed of with the direction that the petitioner’s objections will be duly considered by the authorities once the formal notification process begins.
