IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.R. Swaminathan, J
Mahendran – Appellant
Versus
Government of India – Respondent
W.P. No. 19989 of 2026|W.M.P. Nos. 21351 & 21353 of 2026
For the Appellants/Petitioners: C. Prabakaran
For the Respondents: M. Sathyan, B. Vijay, M. Murali
Property owners' objections regarding land acquisition must be duly considered by authorities once the formal statutory notification under the Industrial Purposes Act is issued by the government.
Headnote:The petitioner challenged the intended land acquisition for the Metro Rail Project on the premise that their objections were not being considered. The court evaluated the procedural status of the acquisition under the governing land acquisition statute. It was established that the formal notification process had not yet commenced at the time of the petition. The core issue is whether the petitioner's objections would be considered during the mandatory land acquisition procedures. The court reasoned that since the statutory notification process was yet to be initiated, the grievance was premature, and the authority was duty-bound to process objections once the notification is issued as mandated by law. The writ petition stands disposed of following the statement by the respondent's counsel that the petitioner's objections would be duly considered upon the issuance of the statutory notification.
