Kalarani – Appellant
Versus
Government of India – Respondent
W.P. No. 19990 of 2026|W.M.P. Nos. 21355 & 21358 of 2026
For the Appellants/Petitioners: C. Prabakaran
For the Respondents: M. Sathyan, B. Vijay, M. Murali
State authorities must adhere to procedural due process and consider landowner objections during land acquisition proceedings initiated under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997.
Headnote:The petitioner challenged an official communication regarding land acquisition for the Metro Rail Project, seeking to restrain the authorities from proceeding without considering filed objections. The court noted the statutory requirement to adhere to procedural safeguards before final acquisition. Finding the submission of the respondent counsel that statutory notifications were pending, the court held that the petitioner's grievances would be duly addressed in accordance with the law during the formal acquisition process. The central issue pertains to the procedural requirements for land acquisition and whether a landowner is entitled to have objections heard prior to the issuance of a formal notification. The court observed that since the notification under the relevant state industrial land acquisition statute was yet to be published, the requirement to consider objections remains an integral part of the future process, thereby ensuring fairness and transparency. The writ petition stands disposed of.
