IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.R. Swaminathan, J
Soundra Rajan – Appellant
Versus
Government of India – Respondent
W.P. No. 19992 of 2026
For the Appellants/Petitioners: C. Prabakaran
For the Respondents: M. Sathyan, B. Vijay, M. Murali
In land acquisition proceedings, authorities are statutorily obligated to consider objections raised by landholders once the preliminary acquisition notice is issued under the relevant industrial purposes legislation.
Headnote:The petitioner challenged an official communication regarding the potential acquisition of land for the Metro Rail Project, seeking a writ to quash the proceeding under Article 226 of the Constitution of India. The core facts involve the petitioner's apprehension that land acquisition proceedings were initiated without proper consideration of his objections. The court found that the acquisition process was at a preliminary stage. The main issue was whether the pending status of the acquisition notification allowed for the petitioner’s objections to be heard. The court determined that as the formal notification under Section 3(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, had not yet been issued, the authorities are duty-bound to consider the petitioner's objections once the notification is gazetted. The writ petition is disposed of, with the court recording the submission of the respondent that the petitioner's objections will be duly taken note of upon issuance of the notification.
