IN THE HIGH COURT OF JUDICATURE AT MADRAS
G.R. Swaminathan, J
M Chandra – Appellant
Versus
Commissioner, Tambaram City Municipal Corporation – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: A. Ilayaperumal
For the Respondents: L.S.M. Hasan Fizal

A Writ of Mandamus can be issued directing statutory authorities to consider and dispose of a pending representation regarding building permissions in accordance with the law, provided that natural justice is observed by notifying interested parties.

Headnote:The present case involves a petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to cancel building permissions granted by local authorities. The petitioner alleged irregularities in the approval process and sought for the non-issuance of a completion certificate. The Court, without expressing any opinion on the merits of the contentions, directed the statutory authority to consider the pending representation of the petitioner. The primary issue concerns the procedural obligation of the local authority to adjudicate grievances regarding building approvals. The Court determined that the appropriate course of action is for the authority to dispose of the petitioner's representation in accordance with law, ensuring principles of natural justice by providing notice to interested parties. The writ petition is disposed of with directions to the authority to pass orders within eight weeks.
