Na.Ka.No.120/A1/2024 dated 04.09.2024 and to quash the same and to direct the respondents to regularise the service of the petitioner with effect from the date of completion of 10 years of service as done in the case of all other petitioners in WP.No. 29412/10 dated 23.12.2010, WP.No. 11627 of 2015 dated

26.05.2016 and WP.No. 8933 of 2016 order dated 26.09.2023.

For Respondent(s): Mrs. Mythreye Chandru, AGP

ORDER

This writ petition has been filed challenging the impugned order dated

04.09.2024 passed by the third respondent and seeking a direction to the

respondents to regularize the service of the petitioner .

2. The petitioner has been working as a part-time Conservancy

Worker/Manual Scavenger in the Government Higher Secondary School, Vengalam, Perambalur District, since 2003-2004 and is being paid a meagre

sum of Rs.2,000/- per month from the Parent Teacher Association Fund.

has been granted permanent status. Though he submitted representations seeking regularisation/permanent appointment, no action was taken by the respondents. Relying upon G.O.Ms.No.22, Personnel and Administrative Reforms Department dated 28.02.2006 and various judicial precedents, the petitioner claims entitlement to regularisation after long years of continuous service. Aggrieved by the rejection order of the Chief Educational Officer in Na.Ka.No.120/A1/2024 dated 04.09.2024, the petitioner has filed the present

writ petition.

4. Heard the learned counsel appearing on either side and perused the

materials available on records carefully.

5. The petitioner has placed reliance upon G.O.Ms.111, School Education

(R1) Department, dated 09.05.2012. A reading of the said Government Order would show that the benefit thereunder is applicable only to persons, who had completed ten years of Government Service as daily wage employees as on 01.01.2006. In the present case, the petitioner has admittedly entered service only in the year 2003-2004. Therefore, as on 01.01.2006, the petitioner had not completed ten years of service. Hence, the provisions of G.O.Ms.111 are not

applicable to the petitioner.

6. Further, the said Government Order was intended as a one-time

regularisation scheme and cannot be treated as a continuing scheme applicable in perpetuity. Therefore, the request made by the petitioner has been rightly rejected by the respondents, and this Court finds no reason to interfere with the

impugned order.

7. Accordingly, this writ petition is dismissed. No costs.
