ORDER

This writ petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents to conduct a survey and fix the four boundaries of the petitioner’s land in Survey No.386/4, Rajendram North Village, Kulithalai Taluk, Karur District, based on the petitioner’s online application dated 09.06.2025, within a time frame to be fixed by this Court.

2. The petitioner claims title to the property through a sale deed dated

23.11.2011. The adjacent landowner, namely Rajamanickam @ Ramesh, son of Marimuthu, was interfering with the petitioner’s peaceful possession and enjoyment of the property. Therefore, the petitioner filed a suit in O.S. No.95 of 2020 on the file of the District Munsif Court, Kulithalai, and the same was decreed in favour of the petitioner by granting permanent injunction against the defendant, namely Rajamanickam @ Ramesh, restraining him from interfering with the peaceful possession and enjoyment of the property. The petitioner has also submitted an application along with relevant records. In such circumstances, the petitioner seeks a direction to survey the property.

3. Therefore, the 2nd Respondent is directed to conduct a survey, measure the property, and fix the boundaries with the assistance of the 3rd Respondent. The official respondents shall adhere to the following Standard Operating Procedures:

(i) The official respondents shall issue notice to the petitioner as well as to Rajamanickam @ Ramesh immediately upon fixing the date for conducting the survey at the site. If there are any rival claimants, notice shall also be issued to them in accordance with law.

(ii) After completion of the survey, both parties shall affix their signatures indicating that the survey was conducted to their satisfaction.

(iii) If the parties are not satisfied, the petitioner and Rajamanickam @ Ramesh shall nevertheless affix their signatures indicating their dissatisfaction or protest, along with the reasons for such dissatisfaction or protest.

(iv) The aforesaid procedure shall be strictly followed by all concerned. The entire exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

(v) If the 2nd Respondent requires police protection, the 5th Respondent shall provide the same.

4. With the above observations, this Writ Petition is disposed of.

There shall be no order as to costs.
