ORDER

This writ petition has been filed seeking the issuance of a Writ of Mandamus directing respondents 2 to 7 to consider the petitioner’s representation dated 24.10.2025 and to conduct a survey of the petitioner’s land in Survey No.155/12.

2. The petitioner claims right over the property stating that the petitioner’s father was in possession and enjoyment of the land to an extent of

0.9.00 ares comprised in old Survey No.34/4, for which Patta No.68 was issued. Subsequently, the land was assigned new Survey No.155/12. The petitioner’s neighbour, namely Ayyavu, owns land in Survey No.155/9 and an extent of 0.4.50 ares in Survey No.155/10, abutting the land in Survey No. 155/11, which is a Government pathway serving as the only ingress and egress to the petitioner’s property. According to the petitioner, the said Ayyavu has encroached upon the said pathway. Hence, the petitioner seeks removal of the alleged illegal encroachment made by Ayyavu and, for that purpose, seeks a direction to survey and demarcate the properties based on the petitioner’s representation.

3. According to the petitioner, Survey No.155/11 is a pathway; however, the petitioner seeks survey and demarcation of Survey No.155/12.

Therefore, the 2nd respondent is directed to conduct the survey with the assistance of the 3rd respondent, after issuing notice to the petitioner as well as the 8th respondent and the said Ayyavu in accordance with law. The official respondents shall adhere to the following Standard Operating Procedures:

(i) The official respondents shall issue notice to the petitioner and the 8th respondent immediately upon reaching the spot where the survey is to be conducted. The petitioner and the 8th respondent shall acknowledge receipt of the notice by affixing their signatures.

(ii) After completion of the survey, the petitioner and the 8th respondent shall again affix their signatures indicating that the survey was conducted to their satisfaction.

(iii) If the parties are not satisfied, the petitioner and the 8th respondent shall nevertheless affix their signatures indicating their dissatisfaction or protest, along with the reasons for such dissatisfaction or protest.

(iv) The aforesaid procedure shall be strictly followed by all parties concerned. The entire exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

(v) If any person is found to be in unauthorized possession of, or encroaching upon, the property, the same shall be removed only by following due process of law.

5. With the above observations, this Writ Petition is disposed of.

There shall be no order as to costs.
