IN THE HIGH COURT OF JUDICATURE AT MADRAS
R.Sakthivel, J
Mani – Appellant
Versus
Superintendent of Police – Respondent
Criminal Original Petition

Advocates:
For the Appellants/Petitioners: R.P.Rubanchakaravarthy
For the Respondents: A.Damodaran

A petition seeking protection from police harassment is rendered infructuous and is closed when the competent authority confirms that the enquiry against the petitioner has been concluded and closed.

Headnote:The petitioner filed a petition under S.528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to prevent police harassment during the course of an enquiry. The respondents submitted that an enquiry was conducted following a complaint in C.S.R.No.821 of 2026, which has since been closed as the dispute was found to be civil in nature, rendering the petitioner's presence unnecessary. The main issue was whether the police were harassing the petitioner under the guise of an enquiry. The court found that the investigation had concluded and the matter was civil in nature, therefore justifying no further interference or presence of the petitioner. Resulting in the petition being closed as the purpose of the enquiry no longer exists.
