Headnote:The petitioner sought a writ of mandamus to direct the respondents to allow the operation of a restaurant during night hours by considering a pending representation in light of notified government orders. The Court noted that the respondent government authority had confirmed the existence of a government order permitting shops and establishments to operate 24x7 subject to specified conditions. Consequently, the Court directed that the petitioner's representation be considered in accordance with that government order within a specified timeframe. The primary issue was whether the business establishment could operate during night hours despite the respondents' interference. The Court reasoned that since the government had already formulated a policy allowing 24x7 operations for such establishments, the administration was obligated to process the petitioner's request in conformity with those existing guidelines. The writ petition is disposed of with a direction to the authorities to pass orders on the petitioner's representation within six weeks.
