IN THE HIGH COURT OF JUDICATURE AT MADRAS
D. Bharatha Chakravarthy, J
S. Subbiramaniyan – Appellant
Versus
Commissioner, Hindu Religious and Charitable Endowments (Admn) Department – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: K. Muthu Ganesa Pandian
For the Respondents: D. Gandhiraj, S. Manohar

Disputes regarding individual honors in religious festivals are subject to adjudication under Section 63(e) of the HR & CE Act, and existing judicial orders preventing discriminatory honors must be strictly adhered to by administrative authorities.

Headnote:In this matter concerning a writ of mandamus under Article 226 of the Constitution of India, the petitioner sought to prevent the bestowal of individual honors during a temple car festival to ensure non-discrimination among villagers. The central issue was whether the bestowal of special honors upon individuals at a public religious festival violates the principle of non-discrimination. The court determined that disputes regarding individual honors fall within the administrative jurisdiction of the Joint Commissioner under Section 63(e) of the Hindu Religious and Charitable Endowments Act, and it noted that prior judicial directions already precluded such individual honors for the current year. The Writ Petition stands disposed of.
