IN THE HIGH COURT OF JUDICATURE AT MADRAS
S. Srimathy, J
Marimuthu – Appellant
Versus
Revenue Divisional Officer – Respondent
Writ Petition
For the Appellants/Petitioners: V.G.Vallarasu Chezhiyan
For the Respondents: T.Amjadkhan, M.Aasha
The High Court mandates revenue authorities to follow a strict procedure, including prior notice to stakeholders and formal documentation of survey results, when conducting land measurements and boundary demarcations under a Writ of Mandamus.
Headnote:The petitioner filed a Writ Petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct the revenue authorities to subdivide their property, issue a separate patta, and conduct a land survey with police protection. The petitioner claimed the property as an ancestral asset transferred via a registered settlement deed. The Court held that the authorities must conduct a survey following due process, including issuing notice to the petitioner and any rival claimants. The main issue was whether the respondent authorities are obligated to survey and demarcate the petitioner's property upon request. The Court reasoned that to ensure transparency and prevent future disputes, the process must involve formal notice and documentation, stating, "The official respondents shall adhere to the following Standard Operating Procedures." The Court disposed of the Writ Petition with specific directions for the survey to be completed within three months, requiring the petitioner to bear the costs of the survey and police protection.
