COMMON ORDER

The criminal original petition in Crl.OP.No.11801 of 2022 has been filed to quash the proceedings in CC.No.5152 of 2023 on the file of the Special Court dealing with CCB/CBCID, Egmore, Chennai. The criminal original petition in Crl.OP.No.20059 of 2023 has been filed to quash the proceedings in the final report / charge sheet No.FR-28/2023 dated 27.03.2023 under Sections 465, 467, 468, 471, 420, 120B & 34 of IPC in CC.No.1127 of 2023 on the file of the Metropolitan Magistrate-XI, Saidapet, Chennai.

The case of the defacto complainant is that Vani Enterprises, a Partnership Firm, represented by its Partner Vanishri claims that she is the owner of the land bearing Door No.106 (Old Door Nos.45), Nelson Manickam Road, Chennai in Old S.No.8/1, and 3/2, 5/1 & 5/2 measuring an extent of 3 Grounds and 1902 Sq.Ft. Large extent of land comprised in S.No.8/1 & 8/2 of Vada Agaram Village and it was originally belonged to one Yarlagadda Venkanna Chowdary and others. Thereafter, one B. Padmini, Wife of M.K. Madhusudan Rao had purchased 5 Grounds & 2011 Sq.ft. out of the said land from Yarlagadda Venkanna Chowdary under a Sale Deed dated 30.09.1962 bearing Doc.No.2685/1962. Vani Enterprises purchased the said land from B. Padmini, Wife of M.K.Madhusudan Rao under Sale Deed dated 16.09.1970 bearing Doc.No.2944/1970 registered in the office of the Sub-Registrar, Kodambakkam. Vani Enterprises obtained permission to demolish the building at Door No.45, Nelson Manickam Road, Aminjikarai, Chennai from the Corporation of Chennai on 20.02.2001. Vanisri claiming to be the owner of land bearing Door No.106, Nelson Manickam Road, Aminjikarai, Chennai along with 5 others who are neighbouring land owners, entered into a Development Agreement dated 19.09.2001 to develop about 18 Grounds and 275 Sq.ft. bearing Door Nos.106, 108, 110, 112 & 114 at Nelson Manickam Road with M/s. Ceebros Property Development Pvt. Ltd. Thereafter, due to some misunderstanding and strained relationship, M/s. Ceebros Property Development Pvt. Ltd. filed a suit for recovery against the 2nd respondent in C.S.No.859/2003 before this Court and the said civil suit later came to be disposed pursuant to a Joint Memo of Compromise filed by the parties.
