The petitioner had been serving in a sanctioned post since his initial appointment, yet approval was withheld, leading to the denial of salary under the Grant-in-Aid scheme. The Court found that despite proposals sent by the school management and personal representations, the authorities had failed to act. The core issue was whether the respondent authorities are legally obligated to process the request for approval of appointment for a teacher serving in a sanctioned post in an aided school. The Court reasoned that given the existence of a sanctioned post and the petitioner's qualifications, the administrative delay necessitated a judicial direction to ensure compliance with relevant rules and to prevent further hardship to the teaching staff. ORDER

This writ petition has been filed seeking direction to the first respondent to grant approval of the petitioner’s appointment as Trained Graduate Teacher in the second respondent school with effect from the date of his appointment, i.e., 01.11.2000 and grant all consequential benefits.

The petitioner, a qualified Trained Graduate Teacher holding M.A. and B.Ed degrees, was initially appointed on consolidated pay at St. Mary’s Higher Secondary School, Karaikal-an aided minority institution on 01.11.2000. On the same date, a regular vacancy arose in the post due to the termination of the previous incumbent, Mr.M.Vincent Raja, and the petitioner was appointed to fill the said sanctioned post. She has been in continuous service since then.

Despite possessing the requisite qualifications and the availability of a sanctioned post, the petitioner’s appointment has not been approved by the Directorate of School Education (first respondent) to date, resulting in denial of salary under the Grant-in-Aid scheme and causing prolonged hardship. The school management submitted proposals for approval as early as 19.10.2010. The petitioner also personally submitted a representation to the first respondent on 13.01.2026, seeking expeditious approval. However, no action has been taken so far, necessitating the filing of the present writ petition.

4. Heard the learned counsel appearing on both sides and perused the materials available on records.

Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the first respondent to consider the proposal sent by the second respondent School dated 19.10.2010 and the representation of the petitioner dated 13.01.2026 and pass appropriate orders, on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition is disposed of. No costs.
