The High Court may issue a direction to administrative authorities to consider and dispose of pending representations regarding terminal benefits within a fixed timeframe when such benefits remain unpaid post-superannuation.

PRAYER : Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to sanction pension and other retirement benefits with effect from 01.06.2025 with arrears and interest on the belated payment of the retirement benefits within a time limit.

ORDER

The petition has been filed to direct the respondents to sanction pension and other retirement benefits with effect from 01.06.2025 with arrears and interest on the belated payment of the retirement benefits within a time limit.

2. It is the case of the petitioner that she was appointed as Secondary Grade Teacher on 01.07.1996 and promoted as Trained Graduate Teacher on 25.02.2011 and attained superannuation on 31.05.2025. Though the petitioner was permitted to retire from service, her terminal benefits were not released till date.

3. Aggrieved by the same, the petitioner made a representation dated

06.10.2025 before the respondents, for which, there is no response till date.

Therefore, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 06.10.2025, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs.
