IN THE HIGH COURT OF JUDICATURE AT MADRAS
P.T. Asha, J
K. Siddhan – Appellant
Versus
State Of Tamil Nadu – Respondent
Writ Petition

Advocates:
For the Appellants/Petitioners: EsaiRani Narasimman
For the Respondents: Mythreye Chandru

The High Court may issue a writ of mandamus directing competent authorities to consider and decide upon a pending representation in accordance with law and existing government orders without delving into the underlying merits of the claim.

Headnote:The petitioner seeks a writ of mandamus to direct the respondent authorities to consider a representation dated 26.02.2026 regarding the grant of a special time scale of pay, relying upon G.O.(ID)No.87, School Education Pa.Ka.4(1) Department dated 18.07.2025. The facts involve an individual appointed as a Sweeper/Night Watchman in 2014 who remains without regularization despite available vacancies. The Court, exercising its jurisdiction under Art. 226, finds it appropriate to direct the respondents to consider the representation on merit. The central issue is whether the respondent authorities are obligated to consider the petitioner's request for the specific pay scale granted under a government order. The ratio decidendi rests on the principle that the Court, without expressing an opinion on merits, may direct statutory authorities to dispose of pending representations within a specified timeframe to ensure administrative compliance and procedural fairness. The writ petition is disposed of, with a direction to the respondents to pass appropriate orders on the representation within eight weeks.
