The central issue addressed was whether the court should intervene to enforce a specific deadline for investigation completion under existing statutory frameworks. The court observed that the performance of duties such as bandhobast and court attendance inherently impacts the ability to adhere strictly to prescribed timelines, thereby militating against the issuance of a mandatory directive in this instance. The petition was dismissed.

ORDER

The petitioner / defacto complainant has filed this application seeking a direction to the respondent police to expedite the investigation in Crime No.539 of 2025, dated 06.12.2025 and to file a final report.

2. Mr.A.Albert James, learned Government Advocate (Crl. Side)

takes notice for the respondent.

3. The main contention of the learned counsel appearing for the petitioner is that though statutory period for completion of investigation in Crime No.539 of 2025 on the file of the respondent Police has been completed, the respondent Police has not yet filed the final report.

4. Though the statute prescribes a certain time limit for completion of investigation, the Police are simultaneously burdened with several other duties such as bandhobast, election duty, attending courts, etc. Consequently, completing the investigation within the prescribed statutory period often becomes practically difficult.

5. Therefore, this Court is not inclined to entertain the present petition and this Criminal Original Petition is dismissed.
