PRAYER

: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to pass orders for counting the period of service from 8.06.1993 to 31.05.1994 and 07.06.1994 to 31.05.1995 towards pensionable service and consequently, revise the retirement benefits including regular pension payable to the petitioner from the date of retirement on 31.10.2022 with all consequential and other attendant benefits as per GO Ms.No. 408 Finance (Pension) Department dated 25.08.2009 by considering the representation submitted by the petitioner dated 30.10.2025 in the light of various orders passed by this Court within a time frame.

ORDER

1. The petition has been filed to direct the respondents to pass orders for counting the period of service from 8.06.1993 to 31.05.1994 and 07.06.1994 to 31.05.1995 towards pensionable service and consequently, revise the retirement benefits including regular pension payable to the petitioner from the date of retirement on 31.10.2022 with all consequential and other attendant benefits as per GO Ms.No. 408 Finance (Pension) Department dated 25.08.2009 by considering the representation submitted by the petitioner dated 30.10.2025 in the light of various orders passed by this Court within a time frame.

2. It is the case of the petitioner that she was initially appointed as substitute staff from 08.06.1993 to 31.05.1994 and again engaged from 07.06.1994 to 31.05.1995. Later, she was appointed as Regular PG Assistant on 05.06.1995 and retired from service on 31.10.2022 on attaining her age of superannuation. However, her service during the period from 08.06.1993 to 31.05.1994 and from 07.06.1994 to 31.05.1995 was not counted for her pensionary benefits.

3. Aggrieved by the same, the petitioner made a representation dated 30.10.2025 before the respondents, for which, there is no response till date. Therefore, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 30.10.2025, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs.
