The court directed the respondent authority to consider the petitioner's representation regarding appointment to the post of Health Inspector Grade-II on merits and in accordance with law within a specified timeframe.

This writ petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents herein to consider the Petitioner’s representation dated 02.02.2026 within a time frame as fixed by this Honble court.

ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to consider the petitioner’s representation dated 02.02.2026.

2. The case of the petitioner is that he completed Higher Secondary education and thereafter obtained a one-year Health Inspector Diploma recognized by the Government of Puduchery. Based on the said qualification, he was appointed as Health Inspector Grade -II on contract basis in the Primary Health Centre, Chithodu, Erode District, and his service was extended from time to time. During the Covid-19 pandemic, he worked from April 2020 to December 2021 in fever clinics, Covid care centres, RTPCR swab collection, vaccination drives, and other pandemic control duties, for which he was issued appreciation certificates. According to the petitioner, the Government had earlier granted one-time relaxation for filling vacancies in the post of Multipurpose Health Worker(Male)/ Health Inspector Grade-II. In the subsequent recruitment notification for 1429 posts, preference was expected to be given to the persons, who had rendered Covid duty. However, though he participated in the written examination, he was excluded from certificate verification and selection. Earlier, the second respondent appointed 93 persons to the post of Health Inspector Grade-II, who had completed the one-year Diploma Course. The petitioner submitted representations dated 22.12.2025 and 02.02.2026 requesting extension of the benefit of the said proceedings and appointment to the post of Health Inspector Grade-II, but no orders were passed.

Hence, the present writ petition .

3. Heard the learned counsel appearing on both sides.

Considering the facts and circumstances of the case and taking note of the limited relief sought, the second respondent is directed to consider the petitioner’s representation dated 02.02.2026 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. No costs.
