ORDER

This petition has been filed seeking to to direct the respondents 1

and 2 to conduct land survey and fix survey stone and thereby demarcating petitioner's Land in Survey No.501/1B1A admeasuring 0.17.50 hectares situated at Thenthiruperai Village, Eral Taluk, Thoothukudi District with the help of the 3^rd Respondent by considering the petitioner's Application No.2026/0123/28/001046 dated 12.03.2026

within a stipulated period as framed by this Court.

2. The learned counsel for the petitioner submitted that the

property originally belonged to the petitioner’s father. After the demise of the petitioner’s father, the petitioner, being one of the legal heirs, is

WP(MD). No.10783 of 2026 entitled to the property. However, respondents 4 and 5, who are the adjacent landowners, are interfering with the petitioner’s peaceful possession and enjoyment of the property. Hence, the petitioner seeks a

direction to survey the land and fix the four boundaries.

3. Heard the learned Special Government Pleader appearing

for respondents 1 & 2 and the learned Government Advocate appearing

for the 3^rd respondent.

4. Considering the facts and circumstances of the case, this Court

directs the 1^st respondent to conduct the survey and fix the four boundaries with the assistance of the 2^nd respondent after issuing notice to the petitioner and other legal heirs as well as the respondents 4 and 5. If necessary, seek police protection, the 3^rd respondent shall provide police protection to survey the land. In case the petitioner seeks to install the boundary stone, the same may be provided at the cost of the petitioner. The Court is also directing the Official respondents to adhere

to the following Standard Operating Procedures:

WP(MD). No.10783 of 2026 a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice

of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was

conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their

dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of

receipt of a copy of this order.
