This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the respondents to disburse the subsistence allowance to the petitioner from 01.02.2025 to till date together with interest by disposing the written representation made by the petitioner on 10.10.2025.

ORDER

The petition has been filed to direct the respondents to disburse the subsistence allowance to the petitioner from 01.02.2025 to till date together with interest by disposing the written representation made by the petitioner on 10.10.2025.

It is the case of the petitioner that while he was serving as the Record Clerk, he was placed under the suspension on 31.01.2025, on the basis of the complaint registered against him in Crime No.18/2025, by the Annamalainagar Police Station, for the alleged offence under Sections 318(4), 336(3), 347(2) and 340(2) of BNS, 2023 . It is the case of the petitioner that his subsistence allowance has not been disbursed by the third respondent, though the second respondent instructed the third respondent to take an action for disbursement of subsistence allowance. Therefore, the petitioner made several representation to the third respondent. Since there is no response for the said representation, aggrieved petitioner is before this Court.

3. Heard the learned counsel on either side and perused the materials available on record.

4. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the third respondent to consider the petitioner's representation dated 10.10.2025, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No costs.
