O R D E R

This petition has been filed seeking to direct the respondent to consider the petitioner's representation dated 10.03.2026 to correct the name of the petitioner's name in patta No.274 in survey No.70/2D extend of area 14.50 acres, situated at Thadichery Village, Theni Taluk, Theni District, within the stipulated time as that may be fixed by this Court.

The learned counsel for the petitioner submitted that the petitioner claimed right over the property comprised in Survey No.70/2D, measuring an extent of 14.50 acres in Patta No.274, through a registered Sale Deed bearing Doc.No.8345/2021 dated 02.09.2021 executed by one Thirumal. Thereafter, the petitioner applied online on 10.01.2026 before the respondent for transfer of patta in his favour. However, instead of mutating the patta in the name of the petitioner, the respondent erroneously continued the entry in the name of the petitioner’s vendor, namely Thirumal.

3. The learned counsel further submitted that one Muthulingam, who is the elder brother of father-in-law, had filed a suit in O.S.No.18 of 2021 on the file of the District Munsif Court, Theni. Challenging the maintainability of the suit, the petitioner filed I.A.No.5 of 2022 under Order VII Rule 11 CPC seeking rejection of the plaint. The said application was allowed by order dated 24.11.2025 and consequently, the suit came to be struck off. In the above circumstances, the petitioner submitted a representation before the respondent seeking correction of the patta entry. Since no action was taken on the said representation, the present writ petition has been filed.

4. Heard the learned Additional Government Pleader appearing for the respondent.

5. In view of the facts and circumstances of the case, this Court directs the respondent to consider the petitioner’s application in light of the sale deed and the order dated 24.11.2025 passed in I.A.No.5 of 2022 in O.S.No.18 of 2021.

The respondent shall complete the said exercise within a period of 12 weeks from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of. No costs.
