O R D E R
This petition has been filed seeking to direct the respondents to grant separate Patta in favour of Petitioner for the extent of 45 cents, in Survey No. 116/1, Kaniyakulam Village, Agasteeswaram Taluk, Kanyakumari District, by considering the Application No.2025/0105/30/515337.
2. The learned counsel for the petitioner submitted that the petitioner claims 45 cents of land in Survey No.116/1. The total extent of S.No.116/1 is 1 hectare and 32.5 ares. The petitioner’s claim is limited to 45 cents, as a joint patta was issued under Patta No.6547, which also records the petitioner’s name. The learned counsel further submitted that the petitioner’s father originally purchased the property through a registered sale deed dated 05.06.2006 from the legal heirs of Velayuthaperumal Pillai. Subsequently, the petitioner’s father settled the property in favor of the petitioner through a registered settlement deed dated 27.12.2010. Since then, the petitioner has been in possession of and enjoying the property as a joint patta holder. It was submitted that the respondents have issued separate pattas to certain other individuals, but the petitioner’s claim was not considered. Consequently, the petitioner approached this Court by filing WP(MD).No.9586 of 2015. The Court, by order dated 06.07.2015, directed the respondents to consider and pass appropriate orders. However, no orders have been passed pursuant to that direction. Further, the petitioner submitted an online application for the issuance of a separate patta, which remains pending.
Therefore, the writ petition has been filed seeking appropriate relief.
3. The learned Special Government Pleader appearing for the respondents submitted that the matter is under consideration.
4.It is seen from the records that the land in question belongs to the temple. However, the petitioner’s father had purchased the land, and therefore, it cannot be presumed to be temple land without proper adjudication by the competent authorities. Accordingly, the Thasildar/1st respondent is directed to conduct an enquiry, after issuing notice to the petitioner, the HR & CE Department, and the temple trustee or the executive officer of the temple. The Thasildar/1st respondent shall pass appropriate orders within a period of four months from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. No costs.
