Defendant PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the learned Additional District and Sessions Judge (FTC), Nagercoil, to dispose the E.P.No.14 of 2024 within a stipulated time frame as may be prescribed by this Court by allowing this Civil Revision Petition.

ORDER

The petitioners seek expeditious disposal of E.P.No.14 of 2024 pending on the file of the learned Additional District and Sessions Judge (FTC), Nagercoil.

2. The plaintiffs, who succeeded in a suit for recovery of money, initiated E.P.No.14 of 2024 for putting the decree into execution. Notice has been served on the judgment debtor and the judgment debtor has also filed the counter in the EP. When the matter was posted for enquiry on the side of the judgment debtor, he had filed a memo stating that C.M.P.(MD).No.818 of 2025 in A.S.SR(MD).No.80753 of 2024 is pending before this Court.

Consequently, the Execution Petition has been adjourned repeatedly.

3. Mere pendency of an appeal does not operate as stay of the decree.

If there is no stay from the Appellate Court, the Executing Court shall complete the enquiry and pass orders in the Execution Petition within a period of four (4) weeks from the date of uploading of this order.

4. With the above direction, this Civil Revision Petition stands disposed of. There shall be no order as to costs.
